This player forwarded to me a recent decision by the Malta LGA. This decision is troubling. Betway has an unusual rule -- a limitation of the maximum wager. There is no relationship between this rule, and confiscating a player's balance. Why do they have this rule?

Also, Betway is equally responsible for this breach of terms. Their software could easily be set to limit a player's maximum wager. If this odd rule were so important, why is it buried in terms and conditions, and why doesn't Betway's software enforce it?

As is, the sole purpose of this rule is to rob players. There is no rational basis for it as implemented.

Would Malta LGA reconsider its decision in this matter, and use either English or American contract law as a guide? In both jurisdictions, the "fine print" of terms and conditions is not enforceable if it is both unfair and extremely unusual. It is unfair (giving a book the power to seize winnings, with no real harm shown for breaking it) and unusual (no other books have this rule or anything similar). This rule is simply a "gotcha" rule. Courts abhor contracts that seek unfair advantages over a party, and this contract (the Betway T&C) is horribly unfair.

For the good of the gaming industry, I hope you reconsider this decision. If Betway is permitted to benefit from this tactic (and they have stolen from quite a few players now), the whole gaming industry, as well as Malta LGA's credibility will suffer.
